Terms and Conditions

Use of the Novissimi online store and the placement of any order are subject to acceptance of these Terms and Conditions.

1. Scope

Novissimi offers new, second-hand and/or refurbished technology products, including but not limited to smartphones, tablets, laptops, accessories and related products.

Where applicable, each product page identifies whether the product is new, used or refurbished and provides relevant information regarding its condition or grade.

2. Used and Refurbished Products

The customer acknowledges that a used or refurbished product may show normal signs of previous use, such as minor scratches, marks on the casing or other cosmetic imperfections that do not materially affect its functionality.

Product photographs may be illustrative unless expressly stated to represent the specific individual unit being sold.

The condition, colour, storage capacity, technical specifications and any material deviations relating to a product are stated in its product description where applicable.

Cosmetic wear or characteristics that were clearly disclosed to the customer before purchase do not, by themselves, constitute a defect.

3. Batteries

Used and refurbished products containing rechargeable batteries may have experienced normal reduction in their original battery capacity due to age and previous use.

Where a specific minimum battery-health or capacity level is provided, this will be stated in the product description.

Normal gradual deterioration of battery capacity during use is not, by itself, considered a fault covered by the commercial guarantee unless otherwise expressly stated or required by mandatory law.

4. Prices

Prices are displayed in euros (€) and include applicable taxes where required, unless otherwise stated.

For products sold under the applicable margin scheme for second-hand goods, VAT may not be separately shown on the invoice and may not be deductible by the purchaser, in accordance with applicable tax legislation.

Any shipping costs are displayed before completion of the order.

Novissimi reserves the right to change prices at any time. A change in price will not affect an order that has already been accepted by Novissimi.

5. Orders

Submission of an order by the customer constitutes an offer to purchase.

An order is considered accepted when Novissimi sends the relevant confirmation or begins processing the order.

Novissimi may refuse or cancel an order in particular where:

• the product is unavailable,
• there is an obvious pricing or description error,
• payment fails or cannot be completed,
• there are reasonable indications of fraud or an unauthorised transaction,
• the customer has provided incorrect or insufficient information,
• another objective circumstance prevents fulfilment of the order.

If payment has already been received for an order that cannot be fulfilled, the corresponding amount will be refunded.

6. Payments

Available payment methods are displayed during checkout.

Novissimi does not store full bank-card details when payments are processed through an independent certified payment provider.

Transactions may also be subject to the additional terms and security checks of the relevant payment provider or financial institution.

7. Shipping and Delivery

Products are delivered to the address provided by the customer when placing the order.

Any stated delivery periods are estimates unless a specific binding delivery date has expressly been agreed.

Novissimi is not liable for delays resulting from circumstances outside its reasonable control, without prejudice to any mandatory consumer rights.

Risk of loss of or damage to goods passes to the consumer upon physical receipt of the goods by the consumer or a third party designated by the consumer, in accordance with applicable law.

8. Right of Withdrawal – 14 Days

A consumer making a distance purchase has the right, where applicable under the law, to withdraw from the purchase without giving any reason within fourteen (14) calendar days from receipt of the product.

To exercise the right of withdrawal, the consumer must notify Novissimi through the contact methods made available by the online store by means of a clear statement.

Following notice of withdrawal, the product must be returned within the deadlines provided by applicable law.

The consumer bears the direct cost of returning the product unless Novissimi has agreed otherwise or the return concerns a product delivered defective or different from the product ordered.

The consumer may inspect the product only to the extent reasonably necessary to establish its nature, characteristics and functioning.

The consumer may be liable for any reduction in the value of the product resulting from handling beyond what is necessary for such inspection.

Before returning a smartphone, tablet, laptop or other device, the customer should remove personal accounts, passwords, SIM/eSIM profiles, device locks and services such as Find My iPhone, Google Device Protection or equivalent features where possible.

Statutory exceptions to the right of withdrawal apply where provided by applicable law.

9. Refunds

Following a valid withdrawal, amounts required by applicable law will be refunded using the same payment method used for the original transaction unless otherwise agreed.

Where permitted by law, Novissimi may withhold reimbursement until the product has been received or until the customer supplies evidence that the product has been returned.

10. Statutory Consumer Rights

Consumers retain all rights granted to them under applicable Greek and European Union law where goods do not conform to the sales contract.

These rights are not restricted or removed by these Terms or by any commercial guarantee offered by Novissimi.

11. 12-Month Good-Operation Guarantee for Refurbished Products

Products expressly identified by Novissimi as Refurbished are supplied with a twelve (12) month Novissimi commercial good-operation guarantee from the date of delivery, unless a longer period is expressly stated on the relevant product page.

The guarantee covers faults arising during normal and intended use of the device.

Depending on the nature of the fault and where reasonably appropriate, Novissimi may inspect, repair or replace the product in accordance with the terms of this commercial guarantee and applicable law.

The commercial guarantee does not cover, to the extent that the relevant issue results from:

• drops, impacts, breakage or other accidental/mechanical damage occurring after delivery,
• contact with water, moisture or other liquids,
• fire, power surges or external electrical events,
• improper, abusive or unintended use,
• repair, opening or intervention by an unauthorised third party where that intervention is causally related to the fault,
• use of unsuitable accessories or chargers that caused the fault,
• problems arising exclusively from applications, software or modifications installed by the user,
• rooting, jailbreaking or other unauthorised software modification where related to the fault,
• normal wear and tear of consumable components,
• normal gradual loss of battery capacity,
• cosmetic wear disclosed before purchase or arising after delivery,
• loss, theft or total destruction of the product due to an external event.

These exclusions from the commercial guarantee do not limit any consumer rights that cannot lawfully be excluded or restricted.

12. Personal Data Stored on Devices

Before sending a device for return, repair or technical inspection, customers are advised to make a complete backup and, where possible, remove personal information from the device.

Novissimi does not undertake an obligation to create backups of data stored on devices submitted for technical inspection or repair.

Repair may require a factory reset or replacement of components, which may result in data loss.

To the maximum extent permitted by law, Novissimi will not be liable for loss of data except where such liability cannot legally be excluded or restricted.

13. Limitation of Liability

Novissimi takes reasonable steps to ensure that information, descriptions, prices and technical specifications appearing on the online store are accurate.

However, obvious typographical, technical or system errors may occur.

To the maximum extent permitted by law, Novissimi will not be liable for indirect, incidental or consequential losses that are not a foreseeable and direct result of a breach of its obligations.

Novissimi is not responsible for problems caused by third-party services, telecommunications providers, applications, operating systems, online services or other third-party products unless mandatory law provides otherwise.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

14. Product Compatibility

The customer is responsible for checking before purchase whether a product is suitable for their intended use where the relevant information has been clearly provided by Novissimi.

Novissimi does not guarantee compatibility with third-party services or equipment unless such compatibility is expressly stated in the product description.

15. Website Availability

Novissimi cannot guarantee that the online store will operate continuously or without temporary technical interruption.

Novissimi may perform maintenance, upgrades or temporarily suspend access to the website without liability to the extent permitted by law.

16. Intellectual Property

The content of Novissimi, including its logo, trade name, design, text, graphics and original photographs, is protected by applicable intellectual and industrial property laws.

It may not be reproduced or commercially used without prior authorisation unless permitted by law.

Third-party trademarks belong to their respective owners. Novissimi is not affiliated with product manufacturers unless expressly stated.

17. Third-Party Links and Services

The online store may contain links to or integrations with third-party services.

Novissimi does not control and is not responsible for the content or practices of independent third-party websites or services.

18. Force Majeure

Novissimi will not be liable for delay or failure to fulfil an obligation where this results from circumstances outside its reasonable control, including natural disasters, strikes, war, governmental restrictions or major network or transport disruptions, without prejudice to mandatory consumer rights.

19. Fraudulent, Abusive or Unlawful Use

Novissimi reserves the right to refuse transactions or use of its services where there are reasonable indications of fraud, unlawful activity, abuse of the returns system, use of stolen payment methods or other conduct placing Novissimi or third parties at risk, always subject to applicable law.

20. Changes to These Terms

Novissimi may amend these Terms in relation to future transactions.

Each order is governed by the Terms applicable at the time of that transaction unless a later amendment is required by law or is more favourable to the consumer.

21. Applicable Law

These Terms are governed by Greek law and applicable European Union law.

The choice of Greek law does not deprive a consumer residing in another EU Member State of any mandatory protection available to that consumer under applicable European Union rules.

22. Dispute Resolution

In the event of a problem, customers are encouraged to contact Novissimi first through the contact information provided on the website so that an amicable resolution can be attempted.

Consumers retain the right to refer disputes to competent alternative consumer dispute-resolution bodies, including the Greek Consumer Ombudsman where applicable.

23. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in force.

These Terms apply only to the extent that they are compatible with mandatory provisions of applicable law.
